Selling your own home privately? These are the business terms. The private seller terms are here.

These terms apply when a real estate agency, developer, builder or project marketer buys a plan from ACproperty. Paying for a plan means you agree to them. They are written in plain English on purpose. If anything is unclear, email us before you pay.

1. Who we are

2. What the service is

ACproperty publishes residential sale listings to Chinese buyers in Australia and China through ACproperty and its WeChat channels, and to international buyers through our partner portal network (currently 50+ portals in 40+ countries). You also get a dashboard showing where each listing is published, and reach reports you can share.

ACproperty is a marketing and reach service. It is not a lead-generation service or a sales agency: we do not negotiate, take commission, or promise a number of enquiries, buyers or sales.

Part A — Real estate agencies

3. Agency plans

Starter — $350 a month + GST. Up to 5 listings a month, uploaded by you. No CRM feed.
Office — $400 a month + GST. Unlimited listings for every agent in the office. Your CRM feeds new listings in automatically. Includes a co-branded vendor marketing kit.
Office Plus — $750 a month + GST. Everything in Office, plus your top 4 listings featured each month on the ACproperty 澳洲家园网 WeChat channel and 2 WeChat articles a month about your agency, your listings and the suburbs you sell in.

Plans cover one office (one trading location). Additional offices need their own subscription. You can move up to a higher plan at any time; the new price applies from your next billing date. You must hold a current estate agent licence in the state or territory you operate in.

4. Agency term and cancellation

Minimum term: 6 months. After that your subscription continues month to month until cancelled.

Your subscription starts on the day of your first payment.
The first 6 months cannot be cancelled early. If you stop paying during the minimum term, the remaining months are still owed.
After the minimum term, either of us can cancel with 30 days’ written notice by email. Your subscription ends at the end of the billing cycle after that notice period.
Moving down to a cheaper plan is treated as a change at the end of the minimum term, with the same 30 days’ notice.

5. Agency billing

Plans are billed monthly in advance by card through Stripe, our payment provider. Your card is charged automatically on the same date each month.
If a payment fails we will retry and let you know. If it stays unpaid for 14 days we may pause publishing your listings until it is settled. Pausing does not extend or cancel the term.
We may change prices with 30 days’ written notice. A price change never applies inside your current minimum term.

6. WeChat marketing (Office Plus)

Featured listings and articles are written and published by our team in simplified Chinese on the ACproperty 澳洲家园网 channel. We choose the four listings each month with you, or on your behalf if we don’t hear back. Articles are drafted from the information you give us and from public sources, and you will be sent them for a quick check before publishing where time allows. Unused articles or features in a month do not roll over.

Part B — Developers, builders & project marketers

7. Developer plans

New Home — $500 + GST. One new-build listing for 3 months. You upload it through your dashboard.
Project — $800 + GST. One project page plus up to 10 units for 3 months. We set up the project page from the brochure and price list you send us; you manage the units in your dashboard. Includes 2 posts on the ACproperty 澳洲家园网 WeChat channel.
Project Plus — $1,500 + GST. Everything in Project, for up to 30 units, plus the project featured on our WeChat channel and 1 WeChat article about the project and its suburb.
Extra units — $50 + GST each, on any project plan. Projects over 30 units are quoted separately.

A plan covers one project at one address (or one new home for the New Home plan). A second project or stage needs its own plan.

8. Developer campaign term

One payment. Three-month campaign. There is no subscription and nothing renews automatically. You can renew for another 3 months at any time.

Your campaign starts on the day your listing or project page goes live, which is normally within 1–2 working days of payment (New Home listings: the next working day after you upload).
The campaign runs for 3 months from that date, then the listings come down. We will email you before it ends so you can renew for another 3 months at the plan price current at that time.
The campaign clock does not pause. If you delay sending us your brochure, or delay uploading your units, that time still counts.
Units you mark as sold are removed from the portals but do not free up a slot for a different project.

9. Developer billing

Plans are paid once, up front, by card through Stripe, our payment provider.
Extra units and renewals are invoiced or paid by Stripe link when you order them.

10. Your project information

Prices, completion dates, inclusions and availability on the listing come from you. You are responsible for keeping them accurate and for updating units as they sell.
You must hold the rights to sell the project and to use the renders, floor plans, photos and brochure you send us. Where a project marketer buys the plan for a developer, the marketer confirms they have the developer’s authority to do so.
Enquiries are forwarded to the email address you give us. What happens after that — contracts, deposits, FIRB applications — is between you, the buyer and their advisers.
We do not give buyers legal, tax or FIRB advice. Anything on our site about the foreign investment rules is general information only, and it is your responsibility to check how the rules apply to your project and your buyers.

11. WeChat posts and articles (Project and Project Plus)

Posts and articles are written and published by our team in simplified Chinese on the ACproperty 澳洲家园网 channel, drafted from the material you give us and from public sources. We will send articles to you for a quick check before publishing where time allows. Posts and articles are published within the 3-month campaign and do not roll over or carry to another project.

Part C — Applies to everyone

12. Prices and GST

All prices are in Australian dollars and exclude GST. GST is added at checkout.

13. Refunds

Payments already taken are not refundable, including for months or campaign time you did not use, listings you did not upload, or projects you withdrew early. This does not limit any rights you have under the Australian Consumer Law.

14. Your listings and content

You confirm you have the right to publish every listing, photo, render, floor plan and description you send us, and that the property owner (or vendor) has agreed to international marketing.
You give us a licence to publish, translate, adapt and distribute that content on ACproperty, our WeChat channels and our partner portals for as long as the listing is live with us.
You are responsible for keeping listings accurate and for telling us (or letting your CRM or dashboard tell us) when a property is sold or withdrawn.
Translations are prepared by our team from the English you give us. We take care to be accurate, but the English version you supplied is the one you are responsible for.

15. Partner portals and reach

Our partner portal network is run by third parties and changes over time. Portals may be added, removed or change how they display listings, and individual portals may decline a listing. We do not guarantee that any specific portal, country or audience will carry a particular listing, and these changes do not entitle you to a refund or early cancellation.

16. Dashboard and reports

Your dashboard and reach reports show where listings have been published and the reach data our partners give us. We pass this data on in good faith but cannot verify every figure from every third party.

17. Our responsibility

We will provide the service with reasonable care and skill. To the extent the law allows, our total liability to you for anything arising from these terms is limited to the fees you paid us in the 6 months before the claim. We are not liable for lost commissions, lost sales or other indirect loss. Nothing here excludes rights you have under the Australian Consumer Law that cannot be excluded.

18. Privacy

We collect your business contact details, billing details (handled by Stripe, we never see your full card number) and listing data in order to run the service. We don’t sell your details. Buyer enquiries sent to your listings are passed to the contact on the listing.

19. Changes to these terms

We may update these terms from time to time. We will email you at least 30 days before any change that affects your rights or costs. Continuing to use the service after that date means you accept the new terms. For a developer campaign already paid for, the terms in force on the day you paid apply for that campaign.

20. Governing law

These terms are governed by the laws of Victoria, Australia. Any dispute will be dealt with in the courts of Victoria.
